1. Introduction and Acceptance

Welcome to UmrahDeals Ltd (Company No. 16423580), a company registered in England and Wales with its registered office at 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ. These Terms of Service ("Terms") constitute a legally binding agreement between you and UmrahDeals Ltd ("we," "us," or "our") governing your access to and use of our website, services, and products.

By accessing our website, creating an account, making a purchase, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not use our services.

2. Our Services

UmrahDeals provides the following services:

  • Umrah Travel Packages: Comprehensive travel arrangements including flight bookings, hotel accommodation, and ground transportation for pilgrims traveling for Umrah
  • eSIM Services: Digital SIM card products providing mobile data connectivity in Saudi Arabia and other destinations
  • Visa Assistance Services: Support and guidance for Saudi Arabia tourist visa applications
  • Travel Tools: Free online tools including image cropping for visa photos and itinerary planning services
  • Flight Bookings: Individual flight reservations through our IATA-accredited partner Duffel (in development)
  • Hotel Reservations: Accommodation bookings in Saudi Arabia and transit destinations (in development)

We act as an intermediary between you and various service providers. We facilitate bookings and provide customer support but are not the principal provider of flights, accommodation, telecommunications services, or visa processing.

3. Service Area and Geographic Restrictions

Our services are exclusively available to residents of the United States and Middle East countries. We do not currently serve residents of the United Kingdom, European Union, Canada, or Australia. By using our services, you represent and warrant that:

  • You are not a resident of the United Kingdom, European Union, Canada, or Australia
  • You will not access or use our services while physically located in these restricted territories
  • You will not use VPN or other methods to circumvent these geographic restrictions

We reserve the right to refuse service, cancel bookings, or terminate accounts if we determine that a user is accessing our services from a restricted territory.

4. Eligibility and Account Registration

4.1 Age Requirements

You must be at least 18 years old to use our services and create an account. If you are under 18, bookings must be made by a parent or legal guardian who accepts full responsibility for the booking and compliance with these Terms.

4.2 Account Responsibilities

When you create an account with us, you agree to:

  • Provide accurate, current, and complete information during the registration process
  • Maintain and promptly update your account information to keep it accurate and complete
  • Maintain the security and confidentiality of your account credentials
  • Notify us immediately of any unauthorized access to or use of your account
  • Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

5. Booking Process and Confirmation

5.1 Offer and Acceptance

All prices, availability, and package details displayed on our website constitute an invitation to make an offer. When you submit a booking request, you are making an offer to purchase our services. Your booking is confirmed when we send you a booking confirmation email. The contract between us is formed at that point.

5.2 Package Availability

All packages, flights, hotels, and eSIM products are subject to availability. Prices and availability can change in real-time due to supplier inventory updates. In rare cases, packages shown as available may become unavailable after you submit your booking. If this occurs, we will:

  • Notify you within 24 hours
  • Offer comparable alternatives when possible
  • Provide a full refund if no acceptable alternative is available or if you decline alternatives

5.3 Accuracy of Information

While we strive to ensure accuracy, we cannot guarantee that all information displayed on our website is complete, accurate, or current. We reserve the right to correct errors, inaccuracies, or omissions and to change or update information at any time without prior notice.

6. Pricing and Payment

6.1 Pricing

All prices displayed on our website:

  • Are processed in British Pounds (GBP)
  • May be subject to currency conversion fees charged by your payment processor
  • Include applicable UK VAT where required
  • Are subject to change until booking confirmation

6.2 Payment Methods

We accept payment by credit card, debit card, and other methods supported by our payment processor, Stripe. By providing payment information, you represent and warrant that:

  • You are authorized to use the payment method provided
  • The payment information is accurate and current
  • You will pay all charges incurred by you or anyone using your account

6.3 Payment Processing

All payments are processed securely through Stripe, our authorized payment processor. We do not store your complete payment card details on our servers. Payment card information is subject to Stripe's privacy policy and security standards.

6.4 Payment Schedule

  • eSIM Products: Full payment required at time of purchase
  • Visa Services: Full payment required upon application submission
  • Flight Bookings: Full payment or deposit as specified during booking
  • Umrah Packages: Deposit required at booking, full balance due as specified in booking confirmation

7. Cancellations, Refunds, and Changes

7.1 eSIM Products

  • Pre-Activation: Full refunds available for unused, unactivated eSIMs within 14 days of purchase
  • Post-Activation: No refunds available once an eSIM has been activated or QR code has been scanned
  • Technical Issues: Refunds available for faulty eSIMs that cannot connect despite proper installation

7.2 Visa Services

  • Application Fees: Non-refundable once submitted to Saudi authorities
  • Service Fees: Refundable if we cannot proceed with your application due to document issues we identify before submission
  • Visa Rejection: We are not responsible for visa rejections and cannot refund government processing fees

7.3 Flight Bookings

Flight cancellations and changes are subject to airline policies. As an intermediary, we are bound by the terms set by the airlines, which typically include:

  • Non-refundable or partially refundable tickets depending on fare class
  • Change fees and fare differences for ticket modifications
  • Varying cancellation deadlines and penalties

We will assist you in requesting refunds or changes according to airline policies. Airline refunds may take 8-12 weeks to process.

7.4 Hotel Bookings

Hotel cancellations are subject to individual hotel policies, which may include:

  • Free cancellation windows (typically 24-72 hours before check-in)
  • Partial or full charge for late cancellations or no-shows
  • Non-refundable rates with lower prices but strict cancellation policies

7.5 Complete Package Cancellations

For complete Umrah packages, cancellation terms depend on the timing and components of your booking. We will provide specific cancellation terms in your booking confirmation. Generally:

  • More than 60 days before departure: Cancellation with partial refund subject to supplier penalties
  • 30-60 days before departure: Significant cancellation penalties apply
  • Less than 30 days before departure: Minimal or no refund due to supplier policies

7.6 Force Majeure and Extraordinary Circumstances

In cases of force majeure, natural disasters, pandemics, war, terrorism, or government-imposed travel restrictions, refunds and alternatives are subject to supplier policies. We will make reasonable efforts to assist you but cannot guarantee refunds for circumstances beyond our control.

8. Travel Documentation and Requirements

8.1 Passport Requirements

You are responsible for ensuring you have:

  • A valid passport with at least 6 months validity from your intended date of return
  • Sufficient blank pages for visa stamps and entry/exit stamps
  • A passport in good condition without damage that might prevent entry

8.2 Visa Requirements

For travel to Saudi Arabia for Umrah, you must obtain an appropriate visa. Requirements include:

  • Citizen of eligible country for e-visa
  • Tourist visa (recommended for Umrah purposes)

8.3 Health Requirements

Travelers to Saudi Arabia must comply with mandatory health requirements, including:

  • Polio vaccination certificate for travelers from certain countries
  • Other vaccinations as mandated by Saudi health authorities
  • Health declarations as required at time of entry

8.4 Our Visa Assistance Service

Our visa assistance service provides guidance, document preparation, and application submission support. We help you complete the application correctly but we:

  • Do not guarantee visa approval, which is solely at the discretion of Saudi authorities
  • Are not responsible for visa processing delays
  • Cannot be held liable for visa rejections due to inadequate documentation or other factors
  • Cannot expedite processing beyond standard timelines

9. Financial Protection

9.1 ATOL Protection

Important Notice: Our travel packages are NOT protected under the UK ATOL (Air Travel Organiser's Licence) scheme as we do not serve UK or EU residents. ATOL protection is only available for UK-based customers, which we do not accept.

9.2 Component Protection

  • Flights: Processed through our IATA-accredited partner Duffel, subject to airline terms
  • Hotels: Subject to individual hotel and booking platform terms
  • eSIM: Provided by telecommunications partners with service guarantees
  • Visa Services: Subject to Saudi government processing and our service terms

10. Travel Insurance

Travel insurance is NOT included in our packages and must be arranged separately. Failure to obtain adequate travel insurance is at your own risk. We are not liable for losses that would have been covered by travel insurance.

11. Our Role and Limitations

11.1 Intermediary Status

We act as an intermediary arranging travel services on your behalf. We do not own, operate, or control airlines, hotels, telecommunications networks, or visa processing facilities. The primary contracts for these services are between you and the respective suppliers.

11.2 Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services
  • We are not responsible for service quality, disruptions, delays, or cancellations by airlines, hotels, or other suppliers
  • Our total liability for any claim shall not exceed the amount you paid us for the specific booking in question
  • We are not liable for personal injury, illness, or death except where caused by our negligence
  • We are not liable for loss or damage to your belongings

11.3 Supplier Responsibility

Airlines, hotels, and other service providers are solely responsible for their services. Any claims regarding service quality, delays, cancellations, or other issues should be directed to the relevant supplier. We will assist in facilitating communication but cannot be held liable for supplier failures.

12. Intellectual Property

All content on our website, including text, graphics, logos, images, software, and design, is the property of UmrahDeals Ltd or our licensors and is protected by UK and international copyright, trademark, and other intellectual property laws. You may not:

  • Reproduce, distribute, or create derivative works from our content without written permission
  • Use our trademarks, logos, or branding without authorization
  • Scrape, copy, or mirror our website content or functionality
  • Reverse engineer or attempt to extract source code from our website

13. Prohibited Uses

You agree not to:

  • Use our services for any illegal purpose or in violation of any laws
  • Provide false or misleading information during booking or account registration
  • Use another person's account without permission
  • Interfere with or disrupt our website or servers
  • Attempt to gain unauthorized access to our systems
  • Use automated systems (bots, scrapers) to access our website
  • Engage in fraudulent activities or chargebacks
  • Resell our services without authorization

14. Data Protection and Privacy

We are committed to protecting your personal data in accordance with UK GDPR and applicable data protection laws. Our collection, use, and protection of your personal information is detailed in our Privacy Policy, which forms part of these Terms.

By using our services, you consent to:

  • Collection and processing of your personal data as described in our Privacy Policy
  • Sharing your information with airlines, hotels, and other service providers necessary to fulfill your booking
  • Transfer of your data to Saudi Arabia for visa processing purposes
  • Storage of your data on servers located in the UK, EU, and US

15. Communications and Marketing

15.1 Service Communications

By using our services, you consent to receive transactional emails and communications related to your bookings, including confirmation emails, booking updates, and customer support messages. These communications are necessary for service delivery and cannot be opted out of while using our services.

15.2 Marketing Communications

We may send you marketing communications about our services, special offers, and travel deals. You can opt out of marketing communications at any time by:

  • Clicking the unsubscribe link in any marketing email
  • Updating your communication preferences in your account settings
  • Contacting us at [email protected]

16. Complaints and Dispute Resolution

16.1 Complaints Procedure

If you have a complaint about our services:

  2. We will acknowledge your complaint within 48 hours
  3. We aim to resolve complaints within 10 business days
  4. If unresolved, we will provide details of next steps and escalation options

16.2 Dispute Resolution for US Customers

For customers residing in the United States, any disputes arising from these Terms or our services may be resolved through binding arbitration in accordance with the American Arbitration Association's rules. You agree to:

  • Attempt informal resolution by contacting us first
  • Arbitrate disputes individually, not as part of a class action
  • Follow arbitration procedures as outlined by AAA

However, you retain the right to pursue disputes in small claims court if your claim qualifies. Nothing in these Terms prevents you from reporting issues to relevant consumer protection agencies or regulatory authorities.

16.3 Dispute Resolution for Middle East Customers

For customers residing in Middle East countries:

  • Disputes will first be addressed through our customer service team
  • If unresolved, disputes may be escalated to appropriate local consumer protection authorities
  • You retain all rights provided by local consumer protection laws

17. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. However:

  • US Customers: Your local consumer protection laws may also apply and take precedence where they provide greater protection
  • Middle East Customers: Local consumer protection laws and regulations apply in addition to these Terms where they provide greater protection

Nothing in these Terms affects your statutory rights as a consumer. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

18. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted on our website with an updated "Last Updated" date. Material changes will be communicated via email to registered users. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.

For existing bookings made before changes to these Terms, the Terms in effect at the time of booking will continue to apply to that specific booking.

19. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired.

20. Entire Agreement

These Terms, together with our Privacy Policy and any specific terms provided during booking, constitute the entire agreement between you and UmrahDeals Ltd regarding your use of our services and supersede all prior agreements and understandings.
